TN Visa Immigration Attorney
The TN visa is for Canadian and Mexican professionals who are seeking to work in the U.S. in a pre-arranged business activity for a U.S. employer.
Requirements
- The applicant must be a citizen of Canada or Mexico.
- The job must fall into one of the designated professions listed under the United States-Mexico-Canada Agreement (USMCA).
- The beneficiary must have the required educational credentials or professional licenses for that profession.
- The beneficiary must have a specific job offer from a U.S. employer.
Minimally Required Documents
- Canadian or Mexican passport
- A letter from the U.S. employer detailing the job duties,
- Employee’s resume, university diploma and transcripts, and/or professional license.
For Canadian Citizens
Canadian citizens can apply for TN status directly at a U.S. port of entry (like a land border crossing or an airport). They don't need to visit a U.S. consulate or embassy beforehand to get a visa stamp. They present their application, required documents, and pay the fee to a U.S. Customs and Border Protection (CBP) officer at the time of entry.
For Mexican Nationals
Mexican nationals may file a TN petition with USCIS or apply at a U.S. consulate. They must obtain a TN visa stamp in their passport to be admitted to the U.S. in TN status.
