The H-1B visa is for foreign nationals who want to work in the U.S. in a specialty occupation, which generally requires at least a bachelor's degree or its equivalent. This visa is a popular choice for U.S. employers looking to fill roles in fields like technology, finance, and engineering. 


Requirements 


  • The beneficiary must hold a U.S. bachelor's or higher degree, a foreign degree equivalent to a U.S. bachelor's degree, or a license in a specialty occupation field. Their degree must be directly related to the position. 
  • The position offered must be a specialty occupation that requires the theoretical and practical application of a body of highly specialized knowledge which is normally gained through a bachelor’s degree. 
  • Certified LCA. 


Cap-Subject 


The H-1B visa has an annual numerical limit (cap) of 85,00: 



  • Regular Cap: 65,000 visas are available to all H-1B applicants. 
  • Master's Cap: An additional 20,000 visas are reserved exclusively for individuals who have a master's degree or higher from a U.S. university. 


Because demand is so high, a lottery is often used to choose which applications will be processed.
