I-485 – Adjustment of Status
I-485 Adjustment of Status Attorney
The I-485 application is the process through which individuals already in the United States can apply for a green card (lawful permanent residence) without having to return to their home country. This form is most commonly filed after an approved immigrant petition, such as Form I-130 (family-based) or Form I-140 (employment-based).
Requirements for Filing Form I-485
To qualify, applicants must:
- Have a valid basis for immigration (family, employment, asylum, or other approved petition).
- Be physically present in the United States.
- Be admissible under U.S. immigration law (no disqualifying grounds such as certain criminal or immigration violations).
- Submit a properly completed Form I-485 along with required fees and supporting documentation.
Suggested Supporting Documents
When filing an I-485 application, applicants should generally include:
- Approved immigrant petition (I-130, I-140, or other).
- Birth certificate and passport biographic page.
- Form I-94 or other proof of lawful entry into the U.S.
- Medical examination report (Form I-693) completed by a USCIS-authorized physician.
- Two passport-style photos.
- Evidence of financial support (Form I-864, Affidavit of Support, if required).
- Marriage certificate (for family-based cases) or other relationship evidence.
