DS-260 Immigrant Visa Lawyer

The DS-260 Immigrant Visa Application is the consular process equivalent of the I-485 Adjustment of Status. It is used by individuals who are applying for an immigrant visa outside of the United States.

Once a family-based petition (Form I-130) or employment-based petition (Form I-140) is approved, the applicant will receive instructions to complete the online DS-260 form through the Consular Electronic Application Center (CEAC). This step begins the process of applying for permanent residence through a U.S. embassy or consulate abroad.

Application Process

  • File the DS-260 Online
  • Applicants complete the DS-260 form online and submit it electronically to the Department of State.
  • Submit Supporting Documents to the National Visa Center (NVC)
  • Required documents must be uploaded or mailed to the NVC for review.
  • Attend a Consular Interview
  • Once the NVC has completed their document review and if a visa number is available, the NVC will schedule the consular interview, and applicant will attend an in-person interview at a U.S. embassy or consulate in their home country or country of residence. A consular officer will review the application, verify information and documents, and determine eligibility for an immigrant visa.

Supporting Documents

Applicants are required to provide the following documents as part of their application:

  • Passport valid for at least six months beyond intended U.S. entry
  • Government issued birth certificate
  • Police certificates from all countries of residence
  • Marriage certificate (if applicable)
  • I-797 approval notice for form I-130 or I-140 immigrant petition
  • Evidence of financial support (Form I-864, Affidavit of Support, if required).
  • Medical examination from a panel physician authorized by the U.S. consulate
  • Additional documentation as requested by the U.S. consulate
